As a participant in Building Trial Skills you will use NITA’s learning-by-doing method to practice and perfect your skills in the challenging arts of trial advocacy and persuasion.

In a simulated trial setting you will be performing:

Opening statements and closing arguments 
Direct & cross-examinations
Impeachment
Expert witness examinations
Oral advocacy skills
Case theory and strategy

Following your live and videotaped performances you will be given feedback and critique from the renowned NITA faculty. To conclude the program you will execute a full jury trial, getting to watch real jurors deliberate via closed circuit TV. When they return their verdict you will have a chance to ask them questions and hear their feedback.

Whether you are a recent graduate or a seasoned professional, Building Trial Skills will change the way you approach trials, improving your performance exponentially. It is estimated that this program will provide 44 credits.

    Jeff Senger

    Jeff Senger is a partner at Sidley Austin in Washington, D.C.  He previously served as acting general counsel and deputy general counsel of the Food and Drug Administration, where he worked on the most complex and sensitive FDA-related litigation and provided legal advice to the FDA Commissioner and senior staff. He previously served as Senior Counsel in the Office of the Associate Attorney General at the United States Department of Justice, where he assisted in the oversight of more than 2000 lawyers. In 17 years at the Justice Department, including appointment as a Special Assistant United States Attorney, he served as lead counsel in many civil and criminal trials before juries and judges in federal and state courts, and he argued cases in the United States Circuit Courts of Appeals. He directed civil and appellate training at the Justice Department’s National Training Center. He has served as a federal mediator for the United States District Court and began his career as a law clerk for a United States District Court judge. An award-winning author, he wrote a book entitled Federal Dispute Resolution (Wiley 2003) and numerous law review articles. He has taught trial advocacy, mediation, and negotiation at Harvard Law School, and he is an elected member of the American Law Institute. He is a member of the D.C. Circuit Judicial Conference and has testified as an expert witness before the United States Congress. He is an honors graduate of Harvard College and Harvard Law School.

    Green, Donald

    Donald H. Green is a litigation of counsel resident in the Washington, D.C. office of Pepper Hamilton LLP. His practice covers a wide spectrum of substantive areas, including antitrust, financial, corporate, contract, constitutional, environmental, intellectual property, construction, and tort law. He has been lead counsel in major antitrust cases in the entertainment, telecommunications, and advertising fields. Major cases in other areas include Indian law, highway construction, civil liberties, employment, product liability, and professional malpractice. He has considerable litigation experience against the federal government, being a former Department of Justice trial attorney, and for many years has been on the faculty of the Department of Justice Legal Education Institute.

    In addition, Mr. Green concentrates in mediation and arbitration. He has regularly been appointed as a mediator by the federal and local courts of the District of Columbia. He is experienced in arbitrating cases as counsel for a party and as an arbitrator. Mr. Green has been an arbitrator for the American Arbitration Association since 1968. He has been retained by various federal agencies to resolve disputes through ADR procedures. Mr. Green also conducts training and teaches courses in mediation and arbitration techniques.

    Mr. Green has written and lectured widely on civil litigation and discovery techniques, with articles appearing in the ABA Journal, the D.C. Bar Journal, the ABA TIPS Journal, and the Federal Bar Journal. He is an adjunct professor at the Georgetown University Law Center, teaching courses on trial practice and civil discovery.

    Active in firm management, Mr. Green was managing partner of the Washington, D.C. office from 1993-1999, and was a member of Pepper’s executive committee from 1993-2000, including serving as vice chairman from 1997-1998. Before joining Pepper, Mr. Green was a partner for more than 20 years in another law firm in Washington, D.C., including several years as managing partner. Before entering private practice, Mr. Green was a trial attorney for the U.S. Justice Department. He joined the Justice Department after serving in the U.S. Marine Corps as a trial attorney and defense counsel.

    Mr. Green retired from the Marine Corps Reserve as a colonel in 1985 after more than 30 years of service. He was awarded the Legion of Merit for his work in international public law, particularly the law of war, and also earned the Meritorious Unit Citation. In 1999, Mr. Green was appointed by the Secretary of Defense to the Defense Advisory Committee on Women in the Services, where he serves on the executive committee and chairs the equality management committee. He also is a member of the Defense Joint Services Committee on Professional Ethics, the Marine Corps Reserve Officers Association and several other Marine and military organizations.

    David's principal areas of practice are condemnation and land use litigation, white-collar criminal and civil litigation, and other commercial litigation.

    David's condemnation practice focuses on representing landowners whose property is being taken through the power of eminent domain. He has represented clients in both total and partial takings of various types of property, including retail, commercial, industrial, residential, and raw land. His clients have been involved in takings by virtue of federal, state, and local authority.

    David has significant experience representing clients in civil and criminal litigation. His courtroom experience includes jury trials, injunction hearings, pretrial proceedings, and various discovery disputes.     June M. Jeffries

    June M. Jeffries, a Detroit native, was educated at Wesleyan University in Middletown, Connecticut, and at the Georgetown University Law Center in Washington from which she obtained her Juris Doctorate in 1978.  She practiced law in Detroit from 1978 to 1982 until she relocated to Washington where she served as an assistant U.S. Attorney for the District of Columbia from January 1983 to September 2008.    During that time, Ms. Jeffries served in the Misdemeanor, Grand Jury, Felony One,  Felony Two, and Homicide Sections within the Superior Court Division.  Additionally she did a brief rotation in the Appellate Section and a one year detail to the Civil Division.   While in that division, her case load included a variety of matters including employment discrimination, torts, and contract disputes.  

    The bulk of Ms. Jeffries’ career as an Assistant U.S. Attorney   was spent in the prosecution of homicide cases.  Ms. Jeffries  prosecuted many of the most high-profile and publicized homicide cases the office  handled including U.S. v. Marthell Dean who was convicted of shooting police officer Brian Gibson as he sat in his patrol car, stopped at a red light, opposite the Ibex Nightclub on Georgia Ave.  In 2005, she prosecuted Walter Johnson for the murder of Metro Transit Police officer Marlon Morales who was at the U Street-Cardoza Metro station.  A special interest of hers is the prosecution of child homicide cases.  She was featured in an August 6, 2006, article in the Style Section of the Washington Post entitled, “The Avenger” about her work in prosecuting child homicide cases. 

    She has been awarded numerous special achievement awards by the U.S. Attorney’s Office.  In addition she was named senior litigation counsel in 1992.  In 2000 she was presented the United States Attorney’s Award for Exceptional Performance as an Assistant United States Attorney.  In 2008, she was recognized as a Star of the Bar by the Women’s Bar Association of the District of Columbia.  Ms. Jeffries has served on the faculty of the Trial Techniques Program at Emory University Law School, a mandatory program all students must complete at the end of their second year, since 1992. She has also served on the faculty of the Georgetown University Law Center’s NITA program for several years.  She served a four year term as an at-large trustee of the American Inns of Court.  She has served as faculty member of the Trial Advocacy Workshop of the Harvard University Law School in January since 2005, and with the September Trial Advocacy Workshop since 2008.   She has taught in the mandatory trial practice workshop at the Emory School of Law from 1992 to 2002 and 2011.  Ms.  Jeffries is a former member of the State Bar of Michigan.  She is currently a member of the District of Columbia Bar.  She has been admitted to practice before the Supreme Court of the United States, the United States Courts of Appeal for the District of Columbia and the Sixth Circuit, the United States Tax Court, and the United States District Court for the District of Columbia and the Eastern District of Michigan.

    Having retired from the U.S. Attorney’s Office in 2008, Ms. Jeffries is currently experiencing her sabbatical years or sabbatical life, she does not know which.  Since retirement she has volunteered with the Capital Area Food Bank, the Cherry Blossom Festival, the National Center for Children and Families, the Montgomery County Democratic Central Committee, the Obama Campaign, the Presidential Inaugural committee, the USO at Walter Reed Army Medical Center, and her church amongst other activities. 

    Ms. Jeffries is a member of Peoples Congregational United Church of Christ in Northwest Washington.  She has been director of their Vacation Bible School since 2008.  She serves on the Scholarship Committee and volunteers with the food pantry.

    Sara Kropf

    Sara is an experienced trial lawyer who defends clients in criminal and civil litigation. Before starting this firm, she was a partner in the Washington, DC office of Baker Botts L.L.P., where she represented both public and private companies as well as individuals. Her clients are often accused of serious wrongdoing, such as fraud or conspiracy, and many are targeted by the Department of Justice and the Securities and Exchange Commission.


    On the criminal side, Sara has represented clients in a broad array of cases including those involving securities and accounting fraud, Medicare kickbacks, and RICO claims. On the civil side, she has handled complex litigation for clients in a wide variety of industries such as energy, health care, insurance and financial services.     Zol D. Rainey

    Zol D. Rainey is a native of Lake Forest, Illinois and was educated at Old Dominion University (B.S.), The John Marshall Law School (J.D.), and The George Washington University Law School (LL.M. in Litigation and Dispute Resolution).

    Rainey began his career in law enforcement as a Narcotics Detective for the Virginia Beach, Virginia Police Department and a Detective for the Deerfield, Illinois Police Department.  After 10 years in law enforcement and graduating from law school he joined the United States Navy as a naval officer in the Navy Judge Advocate General’s (JAG) Corps in 2000.  He served as defense counsel at the Naval Legal Service Office MIDLANT; as legal advisor to the Commodore of COMPHIRON 8 while deployed in support of Operation Enduring Freedom; as an adjunct professor at the United States Naval Academy; as aide to the Judge Advocate General of the Navy; and as trial counsel at the Trial Service Office Northeast.

    Rainey left the Navy in 2005, joining the District of Columbia’s Office of the Attorney General, beginning as an Assistant Attorney General in the Juvenile Section, promoted to the Deputy Chief of the Criminal Section, and ending as an Assistant Attorney General prosecuting complex civil cases in the Civil Enforcement Section.  In 2009, Rainey joined the Department of Homeland Security, U.S. Immigration and Customs Enforcement (ICE), Office of the Principal Legal Advisor (OPLA) as an Assistant Chief Counsel for the Arlington, Virginia Office of Chief Counsel; as a Special Assistant to the Chief of Staff for the Director of ICE; as the Deputy Chief of the OPLA Executive Communications Unit; and as the Acting Chief of the OPLA Executive Communications Unit.  As the Deputy Chief and then Acting Chief of the OPLA Executive Communications Unit Rainey reviewed every category of document and legal opinion before it left the ICE Office of the Principal Legal Advisor.  Rainey joined the Consumer Financial Protection Bureau on October 7, 2012, and currently holds the position of Enforcement Attorney where he investigates and is a principle litigation attorney in complex enforcement actions of Federal consumer financial laws.  Since 2008 Rainey has also been an adjunct professor at The George Washington University Law School co-teaching pre-trial civil litigation.

    Sarah K. Rathke

    Sarah Rathke, partner in the Cleveland, Ohio office, is a trial lawyer who has argued and tried cases in state and federal courts around the country and before international tribunals. Her practice focuses on commercial and civil matters, product liability defense and international dispute resolution – and especially on taking such cases to trial, when appropriate. She has represented sovereign governments and national and multinational corporations in forums throughout the US and globally.

    Sarah has litigated a broad variety of cases for a diverse group of clients. Her skills include the ability to present complicated business, financial and scientific concepts to juries. Her trial victories include the representation of NBA star LeBron James in a breach of contract action, the representation of a savings and loan company in a US $500 million action asserted by the FDIC, defending a business partner in a dispute with other partners that resulted in an affirmative counterclaim win for the client, as well as others. Recently, Sarah was retained as substitute trial counsel four months before trial by a financial institution seeking to enforce surety bonds investment guarantees. That case was then settled favorably shortly before trial.

    Sarah has also successfully litigated a variety of non-jury trials, arbitrations and hearings. Selected experiences of this sort include representing the Republic of Ecuador and the Czech Republic in bilateral investment treaty proceedings before tribunals constituted under the auspices of the World Bank and representing corporations in private, commercial arbitration proceedings.

    Sarah has disposed of numerous cases favorably prior to trial as well including through successful pre-trial motions – particularly in products liability and consumer class action matters – and through favorable settlements.

    Sarah has been recognized as a Rising Star in five out of the last seven editions of Ohio Super Lawyers magazine, naming her one of the top 2.5 percent of Ohio lawyers age 40 or under or in practice for 10 years or less. In 2012 she was also one of three lawyers nationwide appointed to the National Institute for Trial Advocacy’s (NITA) Next Generation Faculty. Sarah has lectured on trial advocacy at the Cleveland Marshall School of Law.

    Randall McKnight Starrett II

    For over thirty-five years, Randy Starrett has focused his legal practice on complex commercial litigation and transactions, domestic and international, with an emphasis on intellectual property in the financial and entertainment industries, white-collar crime and corporate and securities matters.

    In addition to counseling clients, he has tried over one hundred and fifty jury and numerous non-jury cases to a verdict in federal and state courts, and argued appeals in the United States Court of Appeals for the Fourth Circuit and the Virginia Supreme Court.  He has also represented clients in Europe and Asia.

    Before entering private practice, he served as a prosecutor in the Commonwealth Attorney’s Office in Fairfax County, VA and for the National Labor Relations Board in Los Angeles, CA.  He was in-house counsel to a large NYSE company.  He also served as Judge Pro Tempore and Commissioner in Chancery for the 19th Judicial Circuit of Virginia, and worked in the United States Senate.

    He has originated programs about the world’s most dangerous and remote lands for the Smithsonian Institution and Discovery Communications; and written and produced the motion picture Tournament of Shadows.  He has undertaken expeditions for National Geographic, and he and his climbing partner were the first non-Soviets to climb all 7,000-meter peaks in Soviet Central Asia.  See: Expeditions Atlas, True Stories of the Adventurers Who Helped Define Our World, National Geographic Society, 2000; National Geographic Magazine, Volume 170, No. 2, August 1986.

    Robin Stutman

    Robin M. Stutman is the U.S. Department of Justice, Executive Office for Immigration Review’s (EOIR) Chief Administrative Hearing Officer.  She previously served as EOIR’s General Counsel from August 2009 – March 2012.
    From 1987 to August 2009, Ms. Stutman served in the Office of Special Counsel for Immigration-Related Unfair Employment Practices, Civil Rights Division, U.S. Department of Justice (DOJ), as a Special Litigation Counsel, Supervisory Attorney, and Senior Trial Attorney.  From 1986 to 1987, she was in private practice.

    From 1982 to 1986, Ms. Stutman worked as a Trial Attorney in the Federal Programs Branch, Civil Division, DOJ, entering on duty through the Attorney General’s Honors Program. From January to May 1981, she served as an intern to the Honorable Joyce Hens Green, U.S. District Court for the District of Columbia.  Ms. Stutman received a bachelor of arts degree in 1978 from the State University of New York at Stony Brook and a juris doctorate in 1982 from the University of California, Los Angeles, School of Law.  She is a member of the District of Columbia bar.

    Daria Zane

    Ms. Daria J. Zane is a Special Master on the Court of Federal Claims.  She decides cases where petitioners claim to have been injured as a result of receipt of a vaccine under the Vaccine Injury Compensation Program.  Before her appointment, Ms. Zane was an Assistant United States Attorney (AUSA) for the District of Columbia. During her tenure as an AUSA, Ms. Zane handled both criminal and civil matters at the appellate and trial levels in federal and local courts in the District of Columbia. She also served as an Assistant General Counsel for the Executive Office for United States Attorneys, representing United States Attorneys across the country in civil and administrative matters and providing legal advice to them. Prior to the U.S. Attorney’s Office, Ms. Zane was a trial attorney for the United States Department of Justice, Environment and Natural Resources Division. There she was trial counsel in civil actions involving public lands and natural resources in the Court of Federal Claims as well as federal district courts and state courts throughout the nation.

    Ms. Zane graduated from the George Washington University Law School with honors where she was a school finalist in the Van Vleck Moot Court Competition. Upon graduation, Ms. Zane served as law clerk to the Honorable Noël Anketell Kramer of the Superior Court of the District of Columbia.

    Ms. Zane was awarded a Bachelor of Science degree in Business Administration from the University of Maryland, graduating summa cum laude.     Henry Su is currently a trial attorney with the Federal Trade Commission in Washington, D.C., where he litigates anticompetitive merger and conduct cases as a member of the Bureau of Competition's Litigation Group. Prior to his current role at the Commission, he served as an attorney advisor to Commissioner J. Thomas Rosch. Like his former boss—a veteran trial lawyer in San Francisco who served as lead counsel on numerous federal and state court antitrust cases before being appointed to the Commission, Henry shares the view that cases are best tried by crafting simple and straightforward stories told through key witnesses and their documents.

    Before joining the Federal Trade Commission, Henry practiced for 20 years with several law firms (including most recently, Howrey LLP in San Francisco and Silicon Valley), doing trial and appellate work, alternative dispute resolution and strategic counseling. Although he specialized in claims and disputes involving antitrust, intellectual property and trade regulation issues, Henry also tried and argued a number of cases involving bankruptcy, creditors’ rights, criminal, habeas corpus, civil rights, veterans and constitutional issues. Many of these cases he took on a pro bono or court-appointed basis—acting on his long-held view that we as trial lawyers enjoy a virtual monopoly on skilled advocacy and therefore have a professional obligation to make those skills available to whomever has a just cause or need to petition the courts for relief.

    When it comes to trial and appellate work, Henry appreciates the value of “learning by doing.” Some skills cannot be effectively acquired or developed except through practice, as he found out when he cut his teeth handling criminal and civil cases pending in the United States District Court for the Eastern District of Virginia—the original “Rocket Docket.” Henry sure wishes he had known some of the National Institute of Trial Advocacy (NITA) techniques and drills when he was a young lawyer. So nowadays he does his part to make NITA training available to younger generations of lawyers. He has taught both in-house NITA programs as a partner at Howrey LLP and public NITA programs such as the Western Regional deposition and trial skills programs in San Francisco. While in private practice, he also supervised and mentored younger lawyers on trials and appeals.

    Henry is a Fellow of the American Bar Foundation and the Litigation Counsel of America.  He has also held leadership roles within a number of bar associations and community service organizations, including the American Bar Association, the National Asian Pacific American Bar Association, and the Federal Circuit Bar Association. He was recognized by Euromoney Institutional Investor PLC as a “Litigation Star” in the 2011 edition of Benchmark Litigation: The Definitive Guide to America’s Leading Litigation Firms and Attorneys.

    As mentioned above, Henry strongly supports public service and pro bono publico work. He has served as an early neutral evaluator and mediator for the Northern District of California’s ADR program and as a member of the Criminal Justice Act appellate panel for the United States District Court for the Northern District of California and the United States Court of Appeals for the Fourth Circuit. His pro bono contributions in 2009 led to his selection in 2010 as a recipient of the California Lawyer’s Attorney of the Year (CLAY) Award and as a recipient of the State Bar of California President’s Pro Bono Service Awards, among other honors. Additionally, his trial victory in American Council of the Blind, et al. v. Social Security Administration was recognized by the Los Angeles and San Francisco Daily Journal as one of the Top Plaintiff Verdicts of 2009.

    Clifford J. Zatz

    Clifford J. Zatz is the senior trial lawyer in the firm's Torts Group. He focuses on the trial of complex medical and scientific cases.

    For almost thirty years, Cliff has defended personal injury cases involving consumer, occupational, and environmental exposure to chemicals and other products. He has tried cases arising out of environmental exposure to trichloroethylene, vinyl chloride, PCBs, and dioxins; formaldehyde in home insulation; and occupational exposure to benzene and isocyanates.

    Cliff has represented clients in individual, class action, and community-wide exposure cases. He was on the defense team in one of the earliest lawsuits alleging personal injury from exposure to trichloroethylene in groundwater. Thirty plaintiffs' claims of neurological injury, immune dysfunction, and "chronic systemic chemical poisoning" were resolved in a three-day summary jury trial in federal district court in Michigan.

    Together with Louisville co-counsel, Cliff defended thousands of claims brought by workers and neighbors at a Superfund site in southeastern Kentucky. After a month-long jury trial, the team won a defense verdict against three coal mining companies that sought $140 million in lost profits as a result of their proximity to the site. The National Law Journal recognized the victory in its annual list of the country's top defense verdicts. The next year, Cliff and his team defended bellwether claims of multiple myeloma, childhood leukemia, and other illnesses in a 52-day jury trial that led to a mass settlement of more than 550 plaintiffs' cases. Later, he and his co-counsel won a week-long arbitration of a tort of outrageous conduct action and, in another bellwether plaintiff case, won summary judgment after excluding all of the causation experts under Daubert.

    Cliff defended two of the nation's largest chemical manufacturers against twenty-five plaintiffs' claims of occupational asthma as a result of exposure to isocyanates and ethylene diamine in the manufacture of the Gore-Tex® waterproof membrane. After a 45-day trial, the jury returned fifty defense verdicts. Cliff successfully defended the verdicts twice on appeal in Kennedy v. Mobay Corp., 579 A.2d 1191 (Md. App. 1991), aff'd per curiam, 601 A.2d 123 ( Md. 1992), which established the "sophisticated user" defense as the law of Maryland. He was also trial counsel for manufacturers of rubber solvent in a four-week trial of three leukemia death cases arising in a Virginia tire manufacturing plant.

    Mr. Toomey, a trial lawyer for over thirty-five years, is a Fellow of the College of American Trial Lawyers. He began his career as an Assistant U.S. Attorney in Washington, D.C, trying numerous felony cases there. Mr. Toomey is the former President of the D.C. Assistant U.S. Attorney's Association He has been in private practice for more than thirty years litigating a wide range of cases including domestic relations, plaintiff and defendant tort cases, professional liability, commercial litigation and white collar crime.

    For over the last twenty years, he has concentrated his practice on Construction Contract matters, litigating them all across the country. For 25 years, from 1979 until 2003, he was a Team Leader of the Georgetown University Law Center's NITA Intensive Session in Trial Advocacy Skills which he co-founded. He and the other co-founders were honored at a dinner held in the Great Hall of the U.S. Supreme Court for their twenty-five years' service. He has been a regular faculty member in NITA's Harvard Teacher Training Program and has taught as well in NITA's San Francisco Teacher Training Program. Additionally, Mr. Toomey has taught in NITA's Advanced Trial Advocacy Program in Boulder, Colorado and numerous other trial advocacy programs nationwide.

    Charles B. Wayne has a wide-ranging trial and appellate practice that includes both civil and white collar criminal matters. In his civil practice he has litigated many types of business disputes, including cases involving ERISA, RICO, securities fraud, and other fraud-based claims; employment and employment discrimination; and products liability. He also has significant experience in the area of professional liability, particularly in matters involving allegations of legal or accounting malpractice.

    In his criminal practice, Mr. Wayne has represented clients charged with or under investigation for violations of a variety of federal and other statutes and regulations.     Stephen Weisbrod is an experienced trial lawyer who represents clients in financial and commercial disputes, corporate bankruptcy and insolvency matters, and criminal investigations and trials. Most of his clients are businesses and individuals seeking payment from insurers, banks, and others liable for breach of contract, fraud, or some other kind of misconduct or breach of duty. He has represented companies, creditors' committees, post-bankruptcy litigation trusts, individual directors and officers, and other individuals and entities in insurance, banking, securities and other types of litigation.

    Mr. Weisbrod's recent and current insurance-related representations have included:
    • Representing a private equity firm seeking coverage for claims alleging breach of duty and negligence in connection with certain investment decisions and claims alleging antitrust violations in connection with the acquisition of certain fund portfolio companies.
    • Representing an international food company in insurance recovery efforts relating to claims and losses arising out of contamination of processed food products, and representing the company in claims against other participants in the product supply chain.
    • Representing the lead plaintiffs in a certified national class action against a major life insurer accused of charging premiums in violation of the "vanishing premium" clause of its policies and imposing improper expense charges and cost-of-insurance deductions.
    • Representing a life insurance investment fund in disputes with an insurer and an investor in the fund.
    • Representing an international law firm in insurance coverage disputes relating to lawsuits and investigations involving allegations of malpractice and fraud.
    • Serving as the debtor's special insurance counsel in a chapter 11 bankruptcy case filed by a major installer of asbestos-containing insulation, and in related arbitration proceedings and state and federal trial-level and appellate litigation.

    Some of Mr. Weisbrod's other commercial and financial litigation representations have included:
    • Representing a plaintiff commodities trader against an international bank in litigation involving claims of negligence and breach of duty.
    • Representing a plaintiff investment advisor in securities litigation against foreign broker-dealers relating to their sale of commercial paper on which the issuer defaulted.
    • Representing the official committee of borrowers in a chapter 11 case filed by one of the country's ten largest home mortgage originators.

    Mr. Weisbrod's criminal defense representations have included:
    • Representing an accountant in a criminal tax fraud case.
    • Representing a lending officer in a criminal bankruptcy fraud case.
    • Representing a teenager accused of gang-related first-degree murder.

    Mr. Weisbrod has tried more than 25 cases in six states and the District of Columbia. His clients at trial have included a defendant accused of the shooting of a rival gang member and attempting to kill a police officer (the defendant was acquitted), as well as an asset manager seeking to recover more than $57 million that it lost when a highly rated Canadian insurance company defaulted on its commercial paper (the case settled before closing arguments). He also has represented many individuals and companies in grand jury and regulatory investigations.

    Mr. Weisbrod has written and lectured extensively on insurance and financial litigation. He has been invited to speak at the American Bankruptcy Institute, the American Bar Association Business Law Section, the Consumer Rights Litigation Conference of the National Consumer Law Center, the District of Columbia Bar, ExecuSummit Seminars, HB Litigation Conferences, the National Association of Criminal Defense Lawyers, the New York City Bar Association, and elsewhere.

    A trial attorney with national counsel, litigation management and mediation experience, Mr. Hake is the Managing Partner of Hake Law, a California based trial practice firm.  Bill has worked primarily in commercial litigation including product liability, construction defect, director and officer, white collar criminal, catastrophic injury, toxic tort, class action and complex litigation defense. Mr. Hake’s experience includes several years as lead Trial Counsel for Cooley Manion Jones Hake Kurowski LLP and fourteen years as lead Trial Counsel at Prindle Decker and Amaro in San Francisco.  For several years he was a Trial Attorney and Partner at Hassard, Bonnington in San Francisco, California.     Mark Austrian graduated from the University of Pennsylvania Law School, where he was on the Board of the Law Review, clerked in the United States District Court for the Eastern District of New York and currently is a Partner in the litigation group of Kelley Drye & Warren in Washington, D.C.  He is an Adjunct Professor at the American University Washington College of Law teaching Advanced Trial Advocacy in the High-Tech Courtroom, a member of the American Law Institute, the E-Discovery Advisory Board of Georgetown Law School, the Board of Directors of the Council for Court Excellence and the Board of Directors of the William B.     John T. Battaglia is a partner at Finnegan, Henderson, Farabow, Garrett & Dunner, LLP, in Washington, DC, specializing in patent and other intellectual-property disputes.  He has had substantial experience as a trial lawyer handling jury and bench trials, evidentiary hearings, and arguments, as well as extensive appellate experience, and has successfully represented clients in an array of different civil and criminal disputes. 

    Over two periods of public service, Mr. Battaglia served at the United States Department of Justice as a trial lawyer and federal prosecutor in trying numerous cases to verdict.  In addition, he was appointed in 2006 as the Department’s deputy associate attorney general, where he managed some of the Department’s largest litigating components; briefed and advised the attorney general and deputy attorney general of the United States; and argued several appeals in courts across the country, including the U.S. Courts of Appeal for the Second, Sixth, Seventh, and Ninth Circuits, as well as for the Federal Circuit. 

    Between his periods of public service, Mr. Battaglia was also a partner at Kirkland & Ellis, LLP, where he handled various patent, IP, and other civil disputes at trial and on appeal.  Prior to that, he had been selected and served as a law clerk to federal judges at both the trial and appellate courts.  He has been teaching trial advocacy since 2006, including as a faculty member at the University of Virginia’s advocacy college.  He lives in Virginia with his wife and family.

    Since 1973, K. Stewart Evans, Jr. has focused on resolving complex legal issues through negotiation, alternative dispute resolution resources, and litigation relating to business planning, business disputes, contract formation and disputes, protection of intellectual property, business torts, and securities. 

    In addition to serving as outside general counsel to several businesses and counseling clients on difficult matters on a project basis, Mr. Evans is a seasoned trial lawyer who has been particularly successful in jury trials. However, he understands the business reasons for clients to avoid the time and expense of litigation, if possible. Mr. Evans uses his trial experience to help clients develop pro-active strategies to avoid litigation, to reduce risks when disputes occur and to achieve their objectives through negotiations and, if necessary, through litigation.

    Mr. Evans received his B.A. from the University of Virginia in 1968. He was a three-year letterman in baseball, a member of the Raven Society and, in 1967-1968, the historian of the College. After receiving his J.D. from the University of Virginia in 1972, he served as a law clerk for the Honorable Robert J. Kelleher of the U.S. District Court for the Central District of California in Los Angeles. Because Judge Kelleher was under consideration for appointment to the Ninth Circuit Court of Appeals and sat by designation quite often, Mr. Evans also had the opportunity to participate in the work of the Ninth Circuit Court of Appeals. Mr. Evans is a member of the Fourth Circuit Judicial Conference. Mr. Evans has lectured extensively on commercial litigation matters, business torts and securities, and has written articles for PC Magazine.

Transporation

Taxi fare from Baltimore-Washington International Airport, National, and Dulles ranges from $15.00 to $90.00.  National Airport is the closest: it is a 15-20 minute ride to/from the listed hotels. The Baltimore-Washington International Airport provides Super Shuttle service to hotels.

Parking

There is no parking available at the Law Center.  We encourage you to take the Metro or taxi cabs to the conference.  If you do drive, there are a few parking lots close to the Law Center.

United States District Court for the District of Columbia Parking and Metro Instructions: 
Parking is extremely limited and can be expensive.  If you choose to park, the following parking lots are located within walking distance to the courthouse.
• Public Parking: Located at 440 3rd St and charges approximately $9.00 to $12.00 per day.  
• Public Parking: Located at intersection of 6th and C St at 601 North Building.  The cost is $10.00 to $12.00 per day.
   
There are two convenient METRO subway stations within walking distance to the Courthouse: Judiciary Square (Red Line), which is located at the east side of 4th St between D & E Streets, and Archives-Navy Memorial (Yellow Line), which is located at 7th and Pennsylvania Ave.

Preparation

Pre-program preparation requires that you become familiar with the FACTS associated with the case file and/or problems.  In order to get the maximum benefit from the program, it is imperative that you prepare as much as possible in advance as time for preparation during the program is extremely limited.  Please refer to the program schedule for assignment details to prepare for your performances in each workshop.

Program materials will be shipped approximately four weeks prior to program's start date from our fulfillment company LexisNexis.  The materials packaging will be from LexisNexis not NITA so please watch out for this shipment.  If you have any questions about your shipment please call LexisNexis at 800.833.9844. 

If you sign up 2 weeks prior to the course you will receive the case file by e-mail and can pick up the textbook at the program.   

Meals

Refreshments will be provided during breaks for all NITA participants.  NITA will provide continental breakfast each morning and lunch the last 4 days.   A list of restaurants within walking distance of the law school will be provided at the program.  

Attire

Attendees are encouraged to wear "courtroom attire" during the program.  Not only might a lawyer's appearance have an effect on the trier of fact, and is thus a matter of concern for the serious advocate, but it has been our experience that attendees dressed more formally than the usual CLE  attire find themselves more easily “getting into character” and presenting a more polished performance.  Dressing for court also provides each attendee with more realistic feedback when watching the recorded performances each day.  On occasion, there may be a casual day during the program that will be announced on-site.
